A class action settlement has been reached in Lanz, et al. v. LHNH LaVista LLC, et al., No. 1:23-cv-05344-LMM, pending before the Honorable Leigh Martin May. Your rights to recover from the Settlement are affected, and there is a deadline to act. Please read the information below and the Long-Form Notice carefully.
The lawsuit alleges that the Defendants — LHNH LaVista LLC, LHNH LaVista TIC II, LLC, LHNH LaVista TIC III, LLC, Silverpoint Management, LLC, and Avenium Group, LLC — are responsible for the Fire and resulting losses to residents. The Defendants deny liability. To resolve the matter, the Defendants have agreed to pay $8,450,000.00 into a settlement fund, to be distributed under a Court-approved Plan of Allocation. The Defendants deny any wrongdoing, and the Court has not ruled on the merits.
The Settlement Class includes Subrogated Insurers. If you are a Subrogated Insurer, you may recover from the Settlement by filing a Recognized Subrogation Claim for property-insurance proceeds you paid to a resident on account of the Fire. Recognized Subrogation Claims are paid on equal footing with residents’ property-loss claims.

The Court will hold a Final Approval Hearing on January 5, 2027, at 1:30 p.m. EST to consider whether the Settlement is fair, reasonable, and adequate; you may appear at your own expense.
Recognized Subrogation Claims for each insured resident equals the property-insurance proceeds you paid to that resident on account of the Fire for personal-property loss (excluding any amounts paid for additional living expenses or loss of use) capped at that resident’s recognized property-loss amount. The actual payment depends on the total of all valid claims.
To recover, you must complete and submit the Subrogation Claim Form, together with all supporting documentation, either online or mail by the Claims Deadline, November 22, 2026.
The Subrogation Claim Form requires you to identify each insured resident, the policy number, the personal-property proceeds paid (stated separately from any additional-living-expense or loss-of-use amounts), and proof of payment and of your subrogation or assignment rights. The Settlement Administrator will validate each claim and may issue a deficiency, decision, or reconsideration notice.

If you do not timely file a Subrogation Claim Form, you will forfeit any right to payment from the Settlement Fund, and the corresponding amount will remain in the Property Loss Pool for the other participants. You will remain bound by the release and bar set forth in the Final Order and Judgment to the same extent as other Class Members.
As a condition of receiving payment, and effective upon payment, you will release all subrogation and reimbursement rights you have or may have against the Defendants and the released parties, and against any Class Member or claimant, on account of the proceeds for which payment is made, as provided in Section 5.2 of the Class Settlement and Release Agreement.
